These terms apply when you use kineticlabs.al, a private analysis page we made for your business, or a free preview of a website we built for you. If you buy a website or a care plan, the Client Service Agreement also applies and takes priority for that purchase.
"We" means Lorin & Co sh.p.k., trading as Kinetic Labs, NIPT K31910024A, Rruga Ibrahim Rugova, Tirana, Albania. "You" means the business using the site, and the person acting for it.
1. Business use only
Our services are for businesses and professionals, not consumers. By requesting a preview or buying, you confirm you act for a business purpose and have authority to act for the business you name.
2. The free preview
- Free, no obligation. A preview costs nothing and creates no obligation to buy. We don't ask for card details to make one.
- Our choice to build. Preview slots are limited. We may decline or queue a request, and the waiting time shown is an estimate.
- What you get. A finished website shown on a private link on our domain, with a small banner. It is online for 14 days (we may extend it).
- One free round of changes before you decide, using the "Request changes" button. Changes must be reasonable and within the scope of what you asked for.
- Ownership. Until you pay, the preview, its design and its code belong to us. You may look at it and share the link with people in your business to decide. You may not copy, download, scrape, recreate or let someone else recreate the design, code, text or images, or use them in any other way, unless you buy the site.
- Your material. To build the preview we may use public information about your business: your current website, your Google listing and reviews, and photos and text you have published. We use them only to show you the preview. If you don't buy, we delete the preview files within 6 months (sooner if you ask). If you would rather we not use something, tell us and we'll remove it.
- Accuracy. We try to make every statement in a preview true and based on your own public information. You must check everything before the site goes live, because it will speak for your business.
3. Private analysis pages
If we contacted you, we may have made a private page analysing your public website. It is our opinion and estimate, made in good faith from public data and tools (for example page speed tests). Figures such as potential visitors or enquiries are estimates, not promises. The page is private and confidential to your business; please don't publish it.
4. Acceptable use
You must not use our site or previews to: break the law; upload content you don't have the right to use; attack, overload or try to access systems you are not allowed to; or impersonate someone else.
5. Intellectual property
Everything on kineticlabs.al (design, text, code, 3D work, logos, the Kinetic Labs name) belongs to us or our licensors. Portfolio items belong to their owners and are shown with permission.
6. No guarantees about results
We build websites to be fast, clear and well made. We can't promise specific outcomes such as search rankings, traffic, enquiries or revenue, because they depend on many things outside our control.
7. Liability
The site, private pages and previews are provided free and "as is". To the extent the law allows, we are not liable for indirect or consequential loss, or loss of profit, arising from them. Nothing in these terms limits liability that cannot be limited by law (for example for fraud, or death or personal injury caused by negligence).
8. Privacy
How we handle personal data is explained in our Privacy Policy.
9. Changes
We may update these terms. The version that applies is the one published when you use the site. Changes do not affect a purchase you have already made, which follows the agreement you accepted at checkout.
10. Law and courts
These terms are governed by the laws of the Republic of Albania. Courts in Tirana have jurisdiction, unless mandatory law gives you the right to go to a court elsewhere.
